Terms of Service
Last updated: October 21, 2026
These Terms govern the services provided by Ballast Engineering LLC, a Wyoming limited liability company ("Ballast", "we", "us"), to clients ("you"). By booking or paying for our services, you agree to these Terms.
1. Services
We provide production engineering services: Production Readiness Reviews, fixed-price implementation projects and monthly engineering plans, as described on ballastengineering.com or in a written proposal. Reviews are engineering assessments, not penetration tests, security certifications or compliance audits (such as SOC 2).
2. Client responsibilities
To perform our services, you must provide timely access to the required resources, including connecting the GitHub repository containing the application's source code. You confirm that you have the right to share this code and access with us.
3. Fees and payment
All prices are in US dollars (USD). Reviews are paid in advance. Monthly plans are billed in advance each billing period. Implementation projects are billed by agreed milestones. Additional development hours are billed at USD 150 per hour. Payments are processed by Stripe or by bank transfer.
4. Refunds and cancellations
Refunds and cancellations are governed by our Refund & Cancellation Policy.
5. Intellectual property
Once paid in full, you own the deliverables created specifically for you, including code and reports. Ballast keeps ownership of its pre-existing tools, methods and general know-how, and grants you a license to use any of them included in the deliverables.
6. Confidentiality
We keep your source code, data and business information confidential and use them only to perform the services, as described in our Privacy Policy.
7. Warranties and limitation of liability
We perform our services with professional care, but we do not guarantee that an application will be free of errors, vulnerabilities or downtime. To the extent permitted by law, our total liability for any claim is limited to the fees you paid for the specific service giving rise to the claim, and we are not liable for indirect or consequential damages, such as lost profits or data.
8. Governing law
These Terms are governed by the laws of the State of Wyoming, USA.
9. Changes
We may update these Terms. The version in effect when you purchase a service applies to that purchase.
